Grounds for relinquishing Vietnamese nationality
According to Clause 1, Article 27 of the 2008 Law on Vietnamese Nationality, Vietnamese citizens who apply to renounce their Vietnamese nationality to acquire foreign nationality can have their Vietnamese nationality renounced.
Cases where Vietnamese nationality has not been relinquished
Clause 2, Article 27 of the 2008 Vietnamese Nationality Law stipulates that a person applying to relinquish Vietnamese nationality must not relinquish Vietnamese nationality, if they fall into one of the following cases:
– Owing taxes to the State or having property obligations to agencies, organizations or individuals in Vietnam;
– Being prosecuted for criminal liability;
– Currently serving a judgment or decision of a Vietnamese Court;
– Being detained awaiting sentence execution;
– Currently complying with a decision to apply administrative measures to send to an educational facility, medical treatment facility, or reformatory.
Cases in which Vietnamese nationality cannot be relinquished
Pursuant to Clauses 3 and 4, Article 27 of the Vietnamese Nationality Law 2008 stipulates as follows:
– People who apply to renounce Vietnamese nationality may not renounce Vietnamese nationality if doing so harms the national interests of Vietnam.
– Officials, civil servants and those serving in the Vietnamese people's armed forces are not allowed to renounce their Vietnamese nationality.
Application for renunciation of Vietnamese nationality
Dossier for renunciation of Vietnamese nationality is specified in Article 28 of the 2008 Vietnamese Nationality Law including:
– Application to renounce Vietnamese nationality;
– Background statement;
– Copy of Vietnamese Passport, Identity Card or other documents specified in Article 11 of the 2008 Vietnamese Nationality Law;
– Judicial record card issued by a competent Vietnamese agency. The criminal record certificate must be issued no more than 90 days before the date of application submission;
– Documents certifying that the person is applying for foreign nationality, unless the law of that country does not regulate the issuance of this document;
– Certificate of no tax debt issued by the Tax Department where the person applying to renounce Vietnamese nationality resides;
– For people who were previously officers, civil servants, public employees or served in the Vietnamese people's armed forces and have retired, quit, been relieved of duty, dismissed, demoted or discharged, or have not yet served. more than 5 years, you must also submit a document from the agency, organization, or unit that has issued the decision to retire, lay off, dismiss, dismiss, demote, demobilize, or serve confirming the relinquishment of Vietnamese nationality. That person's identity does not harm the national interests of Vietnam.
Note: In case Vietnamese citizens do not permanently reside in the country, they do not have to submit the following documents: Criminal record card, Certificate of no debt, paper from the agency, organization or unit that has issued the decision to retire, dismissed, relieved of duty, dismissed, dismissed or demobilized, the serving officer certifies that the person's relinquishment of Vietnamese nationality does not harm the national interests of Vietnam.
Service for relinquishing Vietnamese nationality in 2024
According to Article 29 of the 2008 Law on Vietnamese Nationality, the order and procedures for handling applications for renunciation of Vietnamese nationality are as follows:
- If a person applying to renounce Vietnamese nationality resides in the country, he/she must submit the application to the Department of Justice where he/she resides. If he/she resides abroad, he/she must submit the application to the Vietnamese representative agency in the host country. In case the dossier does not have all the documents specified in Article 28 of the 2008 Vietnamese Nationality Law or is invalid, the dossier-receiving agency will immediately notify the applicant so that the applicant can renounce Vietnamese nationality to supplement and complete it. file.
– In case the person applying to renounce Vietnamese nationality resides in the country, within 5 working days from the date of receiving complete and valid documents, the Department of Justice is responsible for posting a notice of application to renounce Vietnamese nationality. In case the person applying to renounce Vietnamese nationality resides abroad, within 5 working days from the date of receiving complete and valid documents, the Vietnamese representative agency abroad is responsible for posting a notice of I would like to renounce my Vietnamese nationality on my website.
Notices on the website must be kept there for at least 30 days from the date the notice is posted.
– Within 5 working days from the date of receiving complete and valid documents, the Department of Justice sends a written request to the Provincial Police agency to verify the identity of the person applying to renounce Vietnamese nationality.
Within 20 days from the date of receiving the request from the Department of Justice, the Provincial Police agency is responsible for verifying and sending the results to the Department of Justice. During this time, the Department of Justice must verify documents in the application for renunciation of Vietnamese nationality.
Within 5 working days from the date of receiving the verification results, the Department of Justice is responsible for completing the dossier and submitting it to the Chairman of the Provincial People's Committee.
Within 5 working days from the date of receiving the request from the Department of Justice, the Chairman of the Provincial People's Committee is responsible for reviewing, concluding and proposing opinions to the Ministry of Justice.
– Within 20 days from the date of receiving complete and valid documents, the Vietnamese representative agency abroad is responsible for verifying and transferring the documents along with suggestions on applying for renunciation of Vietnamese nationality. In case of necessity, the Ministry of Justice requests the Ministry of Public Security to verify the identity of the person applying to renounce Vietnamese nationality.
– Within 20 days from the date of receiving the written proposal from the Chairman of the Provincial People's Committee or from the Vietnamese representative agency abroad, the Ministry of Justice is responsible for re-checking the dossier, if If you consider that the person applying to renounce Vietnamese nationality is eligible to renounce Vietnamese nationality, then report it to the Prime Minister and submit it to the President for consideration and decision.
– Within 20 days from the date of receiving the Prime Minister's request, the President will consider and decide.
In case of renunciation of Vietnamese nationality, identity verification procedures are exempted
Applications for renunciation of Vietnamese nationality of people falling into one of the cases specified in Article 30 of the 2008 Vietnamese Nationality Law do not have to go through identity verification procedures, specifically:
– People under 14 years old;
– People born and residing abroad;
– People who have settled abroad for 10 years or more;
– People who have been allowed to leave the country under family reunification.
